Please read these Terms before using the website or placing an order. By placing an order, you agree to these Terms. Nothing in these Terms limits any right or remedy that cannot lawfully be limited under Kenyan law.
About us.
The website www.feelnzuri.com (the “Website”) is operated by Maven Luxury Limited, trading as FeelNzuri (“FeelNzuri”, “we”, “us” or “our”). We sell perfumes and related physical goods. Our contact details appear at the end of these Terms.
Definitions.
“Customer”, “you” and “your” mean a person using the Website or purchasing a Product. “Product” means an item offered for sale by FeelNzuri. “Order Confirmation” means our acknowledgement that we have received an order. “Acceptance Notice” means our later confirmation that we accept the order, which may also be a dispatch or collection-ready notice.
Website use.
- You may use the Website only for lawful personal or commercial purchasing purposes.
- You must provide accurate, current and complete information and keep any account credentials confidential.
- You must not interfere with the Website, introduce malicious code, attempt unauthorised access, scrape the Website contrary to our instructions, or use its content unlawfully.
- We may suspend access where reasonably necessary for security, maintenance, suspected fraud or breach of these Terms.
Product information.
We take reasonable care to describe Products accurately. Images are illustrative and colours or packaging may vary slightly because of display settings or manufacturer changes. The quantity, bottle size, concentration and other essential characteristics displayed on the Product page form part of the description.
Perfume preferences and how a fragrance develops on a person are subjective. A personal dislike of a scent is not a defect. This does not affect your rights where a Product is counterfeit, unsafe, faulty, incorrectly supplied or materially different from its description.
You should review the packaging and manufacturer information before use, follow warnings and conduct an appropriate patch test where advised. Stop use and seek appropriate medical advice if you experience a serious reaction.
Prices and payment.
- Prices are shown in Kenya shillings and include applicable taxes unless the Website clearly states otherwise.
- Any delivery or other charge will be disclosed before you submit the order.
- Payment methods available for a transaction are those displayed at checkout or communicated by us for an approved order.
- We may correct an obvious pricing or description error before accepting an order. We will ask whether you wish to proceed at the corrected price or cancel and receive a full refund of money already paid.
- You confirm that you are authorised to use the selected payment method. Payment processing may be performed by regulated third-party providers under their own terms.
Placing an order & forming the contract.
- 01Select the Product and review its description, quantity and price.
- 02Review the order summary, delivery or collection option, total price and the information you have entered. Correct any errors before submitting the order.
- 03Submit the order and complete the required payment process.
- 04We will send or display an Order Confirmation. This acknowledges receipt but does not by itself mean that we have accepted the order.
- 05A binding contract is formed when we send an Acceptance Notice. If only part of an order is accepted, the contract applies only to that part.
Please retain the Order Confirmation, Acceptance Notice and these Terms. We may decline an order for a lawful reason, including lack of stock, payment failure, suspected fraud, an obvious error, delivery limitations or a legal restriction. If we decline a prepaid order, we will refund the affected amount using the original payment method where practicable.
Availability and substitutions.
All Products are subject to availability. We will not substitute a Product without your agreement. If a Product becomes unavailable after payment, you may choose an agreed alternative, wait for restocking where a reasonable date is provided, or cancel the affected item for a refund.
Delivery.
Delivery is available only where offered on the Website or agreed by us. The delivery area, charge and estimated timeframe will be disclosed before the order is accepted. Delivery dates are estimates unless expressly agreed as essential.
- You must provide a complete and accurate delivery address and a reachable telephone number.
- We may use a courier or logistics provider and share the minimum information needed to complete delivery.
- Please inspect the parcel promptly. Report visible transit damage, leakage, a missing item or an incorrect item as soon as reasonably possible, preferably within 48 hours. A delay does not automatically remove statutory rights.
- Risk passes when the Product is delivered to you or to a person you authorised to receive it. Ownership passes after we receive full payment.
Store collection.
Where store collection is offered, we will notify you when the order is ready and provide the collection location and hours. Bring the order reference and reasonable identification. An authorised representative may collect if you notify us in advance and the representative presents the requested identification.
Unless a different period is stated before purchase, a collection order will be held for 10 calendar days after the collection-ready notice. We will attempt to contact you before restocking. Treatment of any prepaid amount will depend on the circumstances and any reasonable, disclosed costs, but your statutory rights remain unaffected.
Cancellations, returns and refunds.
Our Refund and Return Policy forms part of these Terms. It explains voluntary change-of-mind returns and the separate remedies available for faulty, counterfeit, unsafe, damaged, incorrectly supplied or misdescribed Products. Where there is a conflict, mandatory Kenyan consumer law prevails.
Product authenticity and safety.
We aim to source Products through reputable channels and to comply with applicable product, labelling and safety requirements. Do not use a Product if its seal appears tampered with, it has leaked materially, or its packaging contains a safety warning relevant to you. Contact us promptly so that we can investigate.
Complaints.
Send a complaint to info@feelnzuri.com or call +254 794 446 480. Include your name, order number, contact details, the Product concerned, the problem and the remedy requested. We will acknowledge the complaint and seek to resolve it within a reasonable time.
You may also pursue remedies through the Competition Authority of Kenya, another competent regulator, an agreed alternative dispute-resolution process or a court of competent jurisdiction.
Our responsibility.
We are responsible for supplying Products that conform to the contract and for liabilities that Kenyan law does not permit us to exclude. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, defective or unsafe Products where liability cannot lawfully be excluded, or breach of mandatory consumer or data-protection obligations.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, for loss caused by your misuse or failure to follow warnings, or for business losses arising from a purchase made wholly outside consumer purposes. Any limitation is subject to the Constitution of Kenya, the Consumer Protection Act and other applicable law.
Intellectual property.
The Website and its original text, graphics, layout, trade names and logos are owned by or licensed to us and are protected by applicable intellectual-property law. You may view and make a personal copy of order-related material, but you may not reproduce, distribute, modify or commercially exploit Website content without permission or another lawful basis.
Personal data and cookies.
We process personal data as explained in our Privacy Policy. Non-essential cookies and similar technologies are used only in accordance with applicable consent requirements and the choices made through our cookie controls.
Events outside reasonable control.
We are not liable for delay or failure caused by an event outside our reasonable control, provided that we take reasonable steps to minimise the effect and notify affected customers where appropriate. This clause does not remove a right to cancel or obtain a refund where required by law or where performance becomes impossible.
Changes to these Terms.
We may update these Terms for legal, operational or security reasons. The version in force when we accept your order applies to that purchase unless a change is required by law. We will display the effective date and, where appropriate, give reasonable notice of a material change.
General provisions.
- If a provision is found invalid or unenforceable, the remaining provisions continue to apply.
- A failure or delay in enforcing a right is not a waiver of that right.
- You may not transfer contractual rights or obligations without our consent, except where the law permits. We may transfer ours only where this does not reduce your rights.
- These Terms and any non-contractual dispute are governed by Kenyan law. Kenyan courts have jurisdiction, without preventing a consumer from using another forum or remedy available under mandatory law.
